Product Liability and Negligence Settlement

A Case Study

Attorneys with the Law Offices of Peter Miller were recently involved in a lawsuit involving a farm worker who was killed while cleaning a cotton picker. His clothing became entangled in one of the horizontal drive shafts on the front of this huge machine. We learned that the cotton picker, which had been recently purchased, was manufactured with a so-called “dead-man’s switch,” which would automatically stop the drive shafts when the operator left his seat.

The manufacturer of the cotton picker had also equipped this machine’s drive shafts with a telescoping drive shaft guard made out of extremely hard plastic to prevent just this type of injury. Unfortunately, the dead-man’s switch had been disabled and the shaft guards had been removed, leaving the farm hand extremely vulnerable to this type of accident.

We sued both the owner of the farm and the seller of the cotton picker under theories of product liability and negligence. In this instance the manufacturer of the cotton picker had provided safety devices which would have prevented this type of accident, but for whatever reason both of these safety devices had been negligently removed. The lawsuit was settled and very significant financial compensation was obtained before trial.
